Terms of Use

1. Agreement to Terms & Eligibility

By accessing, browsing, or using Alpha Journal (`alphajournal.co.uk`) or any of its public tools, calculators, or services, you agree to be legally bound by these Terms of Use and our Privacy Policy. You must be at least 18 years of age (or the age of legal majority in your jurisdiction) to create an account or use the platform. If you do not agree with any part of these terms, you must immediately stop using the platform.

2. Intellectual Property & Prop Firm Non-Affiliation

The Alpha Journal brand, design system, software code, calculators, and AI-driven workflows are the exclusive intellectual property of Alpha Journal. You may not copy, scrape, reverse-engineer, resell, or redistribute any part of the platform without prior written consent.

3. Financial Risk Warning & Regulatory Status (UK / EU / US / Global)

Trading foreign exchange, futures, CFDs, indices, commodities, equities, options, and cryptoassets carries a high level of risk and may not be suitable for all individuals. You can lose some or all of your capital or evaluation fees. Alpha Journal is strictly a self-directed software journaling, analytics, and educational tool; we do not provide financial, investment, brokerage, tax, or legal advice, nor do we issue trading signals, recommend securities or position sizes, execute trades, or hold client funds.

Alpha Journal is not a financial institution, investment adviser, or broker-dealer, and is not authorised or regulated by the UK Financial Conduct Authority (FCA), European Securities and Markets Authority (ESMA), US Securities and Exchange Commission (SEC), Commodity Futures Trading Commission (CFTC), National Futures Association (NFA), Australian Securities and Investments Commission (ASIC), or any other financial regulator. Every trade, risk parameter, and financial decision you make is 100% your own responsibility.

CFTC Rule 4.41 — Hypothetical & Calculator Disclaimer: Hypothetical or simulated performance results and calculator projections (including Will I Pass?, Consistency Calculator, Consistency Shield, Lot Size, Drawdown Recovery, and Monte Carlo projections) have inherent limitations. Unlike an actual performance record, simulated or mathematical projections do not represent actual trading and do not account for slippage, spreads, commissions, overnight swaps, server timezone differences, or prop firm rule changes. No representation is being made that any account will or is likely to pass an evaluation, receive a payout, or achieve profits or losses similar to those shown.

4. Artificial Intelligence & EU AI Act Transparency (Article 50)

In compliance with Regulation (EU) 2024/1689 (the EU Artificial Intelligence Act, Article 50) and global AI transparency standards, you are explicitly informed that features including "AI Coach", "Pre-Flight", "Screenshot Auto-Fill", "Trade Insight", "Pre-Market Brief", "Roast", and automated support triage are powered by commercial generative artificial intelligence models and produce automated, probabilistic outputs based on the text, CSV files, or chart screenshots you submit.

AI outputs and optical character recognition (OCR) from screenshots may be incomplete, delayed, or inaccurate ("hallucinations"), may misread chart prices or broker files, and must never be relied upon as factual, human coaching, or financial advice. Alpha Journal never performs automated decision-making with legal or similarly significant effects (UK/EU GDPR Article 22) and cannot place, modify, or close trades. You are solely responsible for verifying all imported data, extracted numbers, and rule calculations before acting.

5. Subscriptions, Trials & Billing

New accounts may receive a promotional 14-day Pro trial with no payment card required. Paid subscriptions are billed in advance through our PCI-DSS Level 1 certified payment processor and renew automatically at the end of each monthly or annual billing cycle unless cancelled beforehand via your Dashboard. Founding or locked-in rates remain in effect for as long as your subscription remains active and uninterrupted. We reserve the right to modify standard pricing, plan features, usage quotas, or promotional offers at any time.

6. Refunds, Cancellation & UK/EU Consumer Rights

You may cancel your subscription at any time from your Dashboard. Cancellation stops future billing cycles; you retain access to your paid plan until the end of your current paid period. Except where mandatorily required by applicable law, all subscription fees are non-refundable and we do not issue refunds or credits for partial billing periods, unused quotas, or accidental renewals.

If you are a consumer residing in the UK or EEA, you have a statutory 14-day cooling-off right under the UK Consumer Contracts Regulations 2013 and EU Directive 2011/83/EU, unless you request immediate access to the digital service and acknowledge that doing so waives your statutory right of withdrawal once access has begun. Nothing in these terms overrides mandatory statutory rights that cannot be waived by contract.

7. Promotions, 30-Day Challenge, Referrals & User Content

The 30-Day Discipline Challenge and Refer & Earn program provide promotional rewards (complimentary Pro trial days or subscription balance credits; max one challenge reward ever per user and up to six referral rewards per calendar year). Promotional rewards have no cash value, are non-transferable, and may be modified, withheld, or discontinued at any time at our sole discretion. Self-referrals, multiple accounts, disposable emails, wash/fabricated trades, or leaderboard manipulation will result in immediate forfeiture of rewards and account termination.

You retain ownership of the trade data and screenshots you upload, and warrant that your uploads and chosen leaderboard nickname do not violate any law or third-party rights. If you export or share a performance or challenge card publicly, you do so voluntarily at your own risk.

8. Disclaimer of Warranties & Data Accuracy

The platform and all calculators, imports, analytics, and AI outputs are provided strictly "as is" and "as available" without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the platform will be uninterrupted, secure, or error-free, or that any broker CSV import, consistency formula, drawdown calculation, or AI output will be accurate, complete, or match your broker or prop firm's server calculations.

9. Limitation of Liability & Indemnification

To the maximum extent permitted by law, Alpha Journal, its founder, operators, and affiliates shall never be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any trading losses, lost profits, blown prop firm challenges, breached consistency or drawdown rules, denied payouts, or loss of data arising out of or connected with your use of or inability to use the platform.

Our total aggregate liability to you for all claims of any kind relating to the platform shall not exceed the greater of (a) the total subscription fees you actually paid to us in the twelve (12) months immediately preceding the event giving rise to the claim, or (b) £100 GBP. To the fullest extent permitted by law, you agree to indemnify and hold harmless Alpha Journal from any third-party claims, losses, or legal costs arising from your trading, your content, or your breach of these Terms. Nothing in these Terms excludes liability that cannot lawfully be excluded under English law.

10. Termination, Severability, Governing Law & Dispute Resolution

You may delete your account at any time in Settings. We may suspend or terminate access at any time if you breach these Terms, abuse platform resources, or engage in unlawful conduct, or due to events beyond our reasonable control (including third-party cloud, payment, or AI provider outages). We may update these Terms by posting the revised version on this page. If a change materially affects your rights or your subscription, we will email you before it takes effect; if you do not agree, you may cancel and delete your account.

If any provision of these Terms is found unenforceable, that provision shall be enforced to the maximum extent permissible and the remaining provisions shall remain in full force. Nothing in these Terms limits your statutory rights as a consumer. If you use Alpha Journal for business purposes, claims must be brought individually (not as part of any class or representative action). These Terms are governed by the laws of England and Wales, subject to the exclusive jurisdiction of the courts of London, UK (without prejudice to mandatory statutory consumer protections in your country of residence).
